These Terms of Service ("Terms") constitute a legally binding agreement between you and Adventure On, Inc. ("Adventure On," "we," "us," or "our"), a Delaware corporation, governing your access to and use of the Adventure On mobile application, website located at adventureon.app, and all related services (collectively, the "Platform").
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
IMPORTANT: SECTION 16 CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
1. WHAT ADVENTURE ON IS
Adventure On is a video-first travel marketplace and online travel agency ("OTA"). We provide two distinct services:
(a) TRAVEL INSPIRATION & PLANNING TOOL — Similar to content curation platforms, we allow you to save publicly available travel videos and content from third-party social platforms (Instagram, TikTok, and others) to organize trip inspiration, generate AI-powered itineraries, and plan travel. This is a content-organization and planning feature only.
(b) ONLINE TRAVEL AGENCY — Similar to major travel booking platforms, we facilitate bookings of flights, hotels, tours, activities, and experiences ("Travel Services") through partnerships with licensed travel technology providers and travel suppliers. When you book through Adventure On, you enter into a contract with the relevant airline, hotel, or tour operator ("Travel Supplier"). Adventure On acts as your agent in facilitating that booking and is not the airline, hotel, or experience provider.
2. ACCEPTANCE AND ELIGIBILITY
By using the Platform, you represent and warrant that: (a) you are at least 13 years of age; (b) if you are under 18, you are using the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms; (c) you have the legal authority to enter into binding contracts; (d) you are not prohibited from using the Platform under applicable law; and (e) all information you provide is accurate and complete.
Note: While the Platform is accessible to users 13 and older, specific Travel Services (such as hotel check-ins or car rentals) may require you to be at least 18 or 21 years of age as required by the Travel Supplier.
AdventureOn is intended for users located within the United States. We do not intentionally target or provide services to individuals located outside the U.S.
3. ACCOUNT REGISTRATION
Certain features require account registration. You agree to: (a) provide accurate, complete registration information; (b) keep your password confidential; (c) notify us immediately at maruf@adventureon.app of any unauthorized access; and (d) take responsibility for all activity under your account.
We may suspend or terminate accounts that violate these Terms, provide false information, engage in fraud, or remain inactive for an extended period.
4. TRAVEL BOOKINGS — OTA SERVICES
4.1 Our Role as Agent
Adventure On acts as a disclosed agent facilitating Travel Services between you and Travel Suppliers. Your contract for travel (including flights, hotel stays, and tours) is with the applicable Travel Supplier, not with Adventure On. Travel Suppliers' own terms and conditions, conditions of carriage, and applicable tariffs also apply to your booking and are provided to you at or before the time of booking.
4.2 Duffel (Flight & Hotel Technology Partner)
Flights and hotel bookings on the Platform are powered by Duffel Technologies Limited ("Duffel"), an IATA-accredited travel technology company. By booking flights or hotels through Adventure On, your booking is processed through Duffel's systems. Your contract for air carriage remains with the relevant airline. Duffel's role is as a technology intermediary only.
4.3 Tours, Activities & Experiences
Tours, activities, and experiences are sourced through third-party providers including Viator, GetYourGuide, and direct operators. Your contract is with the relevant operator. Adventure On earns a commission on these bookings.
4.4 Payment — Stripe
All payments on the Platform are processed by Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. Adventure On does not collect, store, or have access to your full payment card number. Card data is transmitted directly to Stripe using industry-standard encryption.
4.5 Pricing and Availability
Travel Service prices are dynamic, set by Travel Suppliers, and subject to availability and change until a booking is confirmed. We reserve the right to correct obvious pricing errors. If a pricing error has affected your booking, we will notify you and offer you the option to confirm at the correct price or cancel without penalty.
4.6 Cancellations, Changes, and Refunds
Cancellation and refund policies are set by the applicable Travel Supplier and vary by booking type. Applicable policies are clearly disclosed before checkout. To request a cancellation or modification, contact us at maruf@adventureon.app or contact the Travel Supplier directly. Adventure On's service fees are non-refundable unless required by applicable law.
5. TRAVEL ACCREDITATION AND STATE REGISTRATION STATUS
5.1 Accreditation
Adventure On facilitates flight and hotel bookings through Duffel Technologies Limited, which holds IATA and ARC (Airlines Reporting Corporation) accreditation. Bookings made through Adventure On are issued under Duffel's agency accreditation.
5.2 State Seller of Travel Registrations
Four U.S. states — California, Florida, Hawaii, and Washington — require any business selling travel to their residents to hold a state Seller of Travel registration. Adventure On is currently in the process of obtaining these registrations.
UNTIL ADVENTURE ON HAS OBTAINED THE APPLICABLE STATE SELLER OF TRAVEL REGISTRATION, BOOKING SERVICES ARE NOT AVAILABLE TO RESIDENTS OF CALIFORNIA, FLORIDA, HAWAII, OR WASHINGTON. By proceeding with a booking, you represent that you are not a resident of any of those four states.
6. TRAVEL SUPPLIER LIMITATIONS
Adventure On is not responsible for and has no liability to you for:
Acts or omissions of any airline, hotel, tour operator, or other Travel Supplier.
Flight delays, cancellations, or schedule changes made by airlines.
Overbooking, property changes, or service failures at hotels.
Force majeure events including natural disasters, pandemics, or government-imposed travel restrictions.
Your failure to comply with Travel Supplier requirements (passports, visas, health documentation).
7. TRAVEL ADVISORIES AND SAFETY
Any safety or routing information displayed on the Platform is provided for informational purposes only. Adventure travel — including mountaineering, backcountry skiing, and surfing — involves serious inherent risks including death. You assume all risks associated with your travel activities. Before undertaking any adventure travel, consult official government travel advisories (travel.state.gov).
8. CONTENT SAVING AND SOCIAL MEDIA FEATURES
8.1 What the Save Feature Does
Similar to content curation tools, Adventure On's save feature allows you to save publicly available travel videos and content from third-party social media platforms ("Social Content") through native sharing mechanisms. Adventure On does not re-upload, republish, host, or distribute Social Content on its servers. The Platform stores references and metadata to help you organize your travel inspiration.
8.2 Your Responsibilities
By using the save feature, you represent and warrant that:
You are saving publicly accessible content only for personal, non-commercial trip planning.
You will not use the save feature to systematically scrape or commercially exploit third-party content.
You understand that third-party platform terms (Instagram, TikTok, etc.) continue to apply to any content you access or save from those platforms.
9. USER CONTENT
You retain all ownership rights in any reviews, trip notes, or photos you submit ("User Content"). By submitting User Content, you grant Adventure On a worldwide, royalty-free license to use, store, and display your content solely for the purpose of operating and promoting the Platform. This license ends when you delete your content or close your account.
10. PROHIBITED ACTIVITIES
You agree not to:
Book travel using false or fraudulent payment information.
Use bots, scrapers, or automated tools to access the Platform or extract data.
Reverse engineer or attempt to extract source code from the Platform.
Post false, misleading, or defamatory reviews or content.
Impersonate any person, entity, or Travel Supplier.
11. DISCLAIMERS OF WARRANTIES
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. ADVENTURE ON DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY BOOKING WILL BE FULFILLED AS CONFIRMED DUE TO ACTS OF TRAVEL SUPPLIERS; OR (C) AI-GENERATED CONTENT IS ACCURATE OR SUITABLE FOR YOUR CIRCUMSTANCES. AI-GENERATED ITINERARIES ARE RECOMMENDATIONS ONLY.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVENTURE ON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM OR TRAVEL SERVICES BOOKED THROUGH THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO US IN THE PRECEDING 12 MONTHS; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
13. DISPUTE RESOLUTION — ARBITRATION AND CLASS ACTION WAIVER
ALL DISPUTES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA"), RATHER THAN IN COURT. YOU AND ADVENTURE ON EACH WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR CLASS-WIDE ARBITRATION. These Terms are governed by the laws of the State of Delaware.
14. DMCA — COPYRIGHT INFRINGEMENT NOTICES
Adventure On, Inc. respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). Our Designated Agent is registered with the U.S. Copyright Office (Registration No.: DMCA-1071484). All copyright infringement notices and counter-notices should be sent to maruf@adventureon.app.
14.1 Submitting a Takedown Notice
To submit a valid DMCA takedown notice, provide all of the following to maruf@adventureon.app: (a) identification of the copyrighted work you claim has been infringed; (b) identification of the material on the Platform you claim is infringing, with sufficient detail for us to locate it (e.g., a URL or description of where it appears); (c) your name, mailing address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature. Upon receiving a valid notice, we will promptly remove or disable access to the allegedly infringing content and notify the affected user. False or bad-faith notices may result in liability under 17 U.S.C. § 512(f).
14.2 Counter-Notice Procedure
If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to maruf@adventureon.app. A valid counter-notice must include: (a) your name, mailing address, telephone number, and email address; (b) identification of the material that was removed and the location where it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; (d) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of Delaware if your address is outside the U.S.), and that you will accept service of process from the party who submitted the takedown notice; and (e) your physical or electronic signature. Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action seeking an order to keep the content down, we will reinstate the removed content. False or bad-faith counter-notices may result in liability under 17 U.S.C. § 512(f).
14.3 Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), it is Adventure On’s policy to suspend or terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are found to be repeat infringers of intellectual property rights. A user whose content is removed pursuant to multiple valid DMCA takedown notices may have their account suspended or permanently terminated. We reserve the right to make this determination based on the totality of circumstances.
15. IN-APP ACCOUNT DELETION
In compliance with Apple App Store Guideline 5.1.1(v), users may delete their account and associated personal data by navigating to Settings within the app. Upon deletion, account records are removed, subject to legal retention requirements for booking and financial records.
